In June 2013, plaintiff was traveling in her vehicle when she was struck by Defendant’s vehicle. The initial impact was to the left-front quarter panel and there was a subsequent impact to the left rear quarter panel.

Plaintiff was taken via ambulance to the hospital immediately following the accident where she complained of pain in her neck and back and was discharged under the advisement to follow up with her primary doctor. A few days later, she consulted with her primary care physician where she complained of severe pain to her back radiating into her arm and neck pain.

Prior to the happening of this accident, Plaintiff had pre-existing injuries and had previously undergone a lumbar fusion surgery at L4-5 and L5-S1 with instrumentation as well as anterior cervical discectomy and fusion surgery with instrumentation at C5-6, but was doing well up until this accident. Given her complaints as a result of this accident, she was instructed to see her orthopedist and ultimately underwent an MRI of the lumbar spine which revealed, disc herniations at L3-4. Cervical imaging revealed disc collapse at C4-C5 and space narrowing at C6-C7. She commenced a course of conservative treatment consisting of physical therapy. When the course of conservative treatment failed to alleviate her pain, Plaintiff underwent total discectomy and interbody fusion with a cage and screws at L3-L4.

The case settled for $150,000.00, prior to the scheduling of a trial.
