In November 2016, Plaintiff was operating a motor vehicle when the Defendant struck the rear of Plaintiff’s vehicle suddenly and without warning.
Plaintiff immediately presented to the hospital where he was examined and prescribed medication for his pain and muscle spasms,
and discharged thereafter. Following his discharge, his pain grew worse with each passing day, particularly with respect to his left shoulder and elbow. He consulted with a chiropractor and in response to his complaints, he immediately commenced a course of conservative treatment consisting of chiropractic care. As to his left shoulder and elbow pain, he also commenced treatment with orthopedists. He experienced minimal improvement to his condition during the course of his treatment. In light of his continued pain, he underwent a series of manipulations under anesthesia to my cervical spine, thoracic spine, lumbar spine, and pelvis. When his treatment failed to alleviate his pain, he was recommended a trial of medicinal management, activity modification, and physical therapy.
After concluding his treatment, his symptoms remained unchanged and was recommended and ultimately underwent surgical intervention for his shoulder.
The case settled for $85,000.00, prior to the scheduling of a trial.
Defendants had an argument with respect to causality as a result to the gap of treatment from the date of this accident and the date Plaintiff sought medical attention.
No defenses with respect to liability or damages. No lost wage claim was asserted.
