In October 2015, Plaintiff was fully stopped at a red traffic light when his vehicle was struck in the rear by the Defendant at an excessive rate of speed without warning.
Initially, Plaintiff did not seek medical attention. When he began to experience increasing pain to his neck and back, he immediately presented to a chiropractor. In response to his complaints, he commenced a course of conservative management consisting of chiropractic care and physical therapy. While undergoing treatment, he was referred for diagnostic testing which revealed (1) Right paracentral disc herniation; right posterolateral disc herniation, and central subligamentous posterior disc herniation. In addition, he underwent an upper extremity EMG/NCV nerve test revealed abnormal findings consistent with C2-C4 radiculopathy and bilateral C5-C6 radiculopathy and a lower extremity EMG/NCV EMG/NCV which revealed right L4-5 radiculopathy.
Given the nature and severity of his injuries and the failure for his injuries to resolve with the conservative course of treatment, he was referred to pain management specialist and was recommended epidural steroid injection therapy. He ultimately underwent a cervical epidural steroid injection in April 2016 and a lumbar epidural steroid injection in July 2016.
When the injection therapy did little by way of improvement to Plaintiff’s symptoms and complaints, he was referred to an orthopedic surgeon who recommended surgery, which the Plaintiff ultimately underwent.
The case settled for $350,000.00, prior to the scheduling of a trial.
No defenses with respect to liability or damages. No lost wage claim was asserted.
