The plaintiff, 78 years of age, was traveling south on Tabor Road approaching its intersection of Park Place in Parsippany, when another vehicle disregarded a stop sign and struck his vehicle. The force of the impact was so great that it caused approximately $6,000.00 in property damage. The plaintiff sustained a disc herniation at C6-7 and aggravated pre-existing asymptomatic arthritis at C3-4, C4-5 and C5-6, which resulted in anterior cervical diskectomy and fusion at three levels. The defense argued that given Plaintiff’s advanced age, that the condition in his cervical spine was related to pre-existing degenerative problems and had nothing to do with the accident. Prior to trial, case was settled for $250,000.00, which was the applicable policy limit for the defendant.
