The plaintiff was a pedestrian, pregnant at the time, was walking in the Fireman’s Field parking lot located in Jefferson, with her seven year old daughter. The defendant performed an unusual u-turn back up, striking the plaintiff and knocking her to the ground. As a result of the accident, she sustained two herniated discs in her lower back with deformity of the dural sac. EMG results revealed bilateral left S1 radiculopathy. After conservative care failed to relieve her pain, she underwent two level, lumbar diskectomy and fusion surgery with hardware. There was a $250,000.00 policy limit applicable and the case was settled for $245,000.00 prior to trial to save trial costs.
