$217,000 Settlement for Automobile Accident

The plaintiff, a 50 year old gentleman with a prior history of low back surgery and fusion, was disabled at the time of his accident. The plaintiff was traveling on Mount Pleasant Avenue away from the Rockaway Mall and was alleged to have cut in front of another vehicle by the defense. The plaintiff claimed he did not cut in front of another vehicle immediately before the accident, but, rather, he moved in front of that vehicle several hundred feet before the accident occurred and was stopped and struck in the rear. As a result of the accident, he herniated a disc in his neck and injured his shoulder. His neck required an anterior cervical diskectomy and fusion surgery and underwent arthroscopic surgery for a partially torn labrum on his shoulder. There was significant argument with regard to the issue of liability. After his arbitration hearing, where he was awarded $217,000, his case was settled for that amount prior to trial.
