In March 2017, Plaintiff was walking with rubber-soled boots towards her usual and customary parking space when she slipped and fell on black ice in the commercial parking lot of her apartment building.  She landed on her outstretched right arm with her entire body, causing a severely deformed fracture to her right upper extremity. Upon regaining her composure, she walked into the lobby of the apartment building, where she reported this incident to the building supervisor, placed a call to emergency responders and was taken via ambulance to the hospital.

Physical examination at the hospital demonstrated that as a result of this incident, Plaintiff sustained a right upper extremity deformity to the dorsal aspect of her right wrist along with swelling and diffuse tenderness.  Following her diagnostic findings, she was indicated for surgery and underwent the recommended operation.  She then began a course of physical therapy in order to improve her post-operative pain and functional limitations in her right upper extremity.  No additional treatment and/or surgery was recommended thereafter.

Defendant possessed a commercial policy and in January 2018, the case settled for the amount of $197,500.00, prior to the scheduling of a trial.

No lost wage claim asserted.  No defenses with respect to liability or damages.
