The plaintiff was 50 years of age and she was traveling north on South Dale Avenue in the Township of Roxbury when another vehicle disregarded a stop sign. As a result of the accident, she sustained two bulging discs in her cervical spine. After conservative treatment and injection therapy failed to relieve her pain, she underwent two level anterior diskectomies and fusion surgery. The defense argued that the surgery was unnecessary, but that there were only bulging discs which were common degenerative changes. The case was resolved prior to trial for $195,000.
