My Attorney Died! Now What?

March 22, 2012 | by Andrew Berns

Dear Ask the Attorney:

What recourse do I have when your (sic) attorney dies and the firm abandons you?

– Losing all because of Attorney Negligence

Dear Losing All:

Unfortunately, we cannot provide you with a specific answer to this question. There is not enough information supplied in your question.  It may be a violation of attorney ethics or it may be professional negligence, but without more facts we cannot tell.

If it is an ethics issue: contact the Office of Attorney Ethics of the Supreme Court of New Jersey in Trenton who will provide you the information needed to file a complaint.

If it is a professional negligence issue, contact an attorney who concentrates his or her practice in “Professional Negligence” (also known as Legal Malpractice) and provide him/her with all of the facts to determine whether or not you have an actual case.
