What types of injuries are covered under Workers’ Comp?

Work Injury

To be covered under the Workers’ Compensation Act, in general, an injury must result from an "accident." An accident, in this context, is an unexpected event in the usual work routine like a "trip and fall," for example. There are exceptions to this, however.  For example, for back injuries, the worker need only experience a "specific traumatic incident," such as a sudden onset of pain while performing routine lifting.

Occupational Exposure

A worker who suffers from an illness or disease from a toxic exposure in the workplace may be entitled to damages beyond those recoverable through workers' compensation. A worker who, over a period of time at work, develops an illness or disease because of an exposure to fumes or chemicals at work or who develops pain in the back, neck, shoulders, arms, hands or legs because of repetitive use of these body parts, may have the right to file an occupational claim in workers' compensation court.

Workplace Accidents where someone else is at fault (Third Party Negligence Actions)

Construction sites are often the scene of an accident. When a worker is injured at a construction site, he may be entitled to compensation from his employer, from other contractors on the site, and from the manufacturer of defective products at the job site.
