Divorce and Other Family Law Issues

There are many legal issues that must be resolved when a couple decides to divorce. If there are children from the marriage, there will be issues of child custody, child support and visitation. The parties must allocate debts and divide marital assets. In all the disputes and feelings of animosity, allegations of domestic abuse may arise. Our family law attorneys help clients resolve all issues and concerns that arise within divorce, such as:

  • Property division: Division of marital property includes division of all assets and debts acquired throughout the marriage, including stocks, 401K plans, pensions, real estate and other property. Such issues may have already been addressed in a prenuptial agreement.
  • Child Custody, Visitation and Support: We work with parents to create parenting plans that work for their unique circumstances. The parenting plan addresses where the child will live (physical custody), who will make decisions about the child's life (legal custody), and how the non-custodial parent will have sufficient parenting time (visitation). In addition, child support calculations are performed taking into account the parenting plan.
  • Move away/out of state: Occasionally, there is a need for a parent to move a significant distance from the other parent for employment, financial or other personal reasons. It is important for parents to consider how the move will affect the child — whether it means moving with the child away from the non-custodial parent or moving away from the child (as a non-custodial parent). We help you resolve all legal issues that may arise in parent and child relocation matters.

Domestic Violence

Is your spouse abusive? If so, there is a way out. We can help. We assist in applications for restraining orders and represent you in court when a decision on a final restraining order is made. We are tenacious advocates who will make sure that your rights are respected. Call a New Jersey domestic violence lawyer at Einhorn Harris today to find out more.

Civil Unions

Gay and lesbian couples face many of the same family law issues that other families endure. We help clients with legal issues that surround their civil union, such as establishing civil union agreements (including estate planning and inheritance rights), adoption, domestic violence, dissolution of the civil union (child custody, property division and other issues) and other legal concerns.

Other Family Law Services

We draft and review prenuptial agreements. We can also assist you in requested modifications to your original divorce decree. We also have the skill to resolve other family law issues that arise. View some family law frequently asked questions.
