New Jersey Divorce and Mediation Lawyers-Einhorn Harris Ascher Barbarito & Frost - Einhorn, Harris, Ascher, Barbarito & Frost PC

New Jersey Divorce Attorneys

The New Jersey divorce lawyers of Einhorn, Harris, Ascher, Barbarito, & Frost, P.C. represent clients with regard to all divorce and divorce-related legal proceedings. Four of the firm's matrimonial law attorneys are certified by the Supreme Court of New Jersey as matrimonial lawyers. They understand the many legal issues which divorcing couples face.

Contested Divorce

The parties in contested divorce cases usually cannot agree on the terms of divorce. When a New Jersey divorce is contested, the couple involved lets the court system decide the matters related to the divorce.

Uncontested Divorce

The parties to an uncontested divorce are in agreement on all key matters such as child custody and division of assets. The court merely serves to legalize their divorce decree.

Mediation

Mediation attorneys can be used to resolve disputes in actions for divorce and their related issues. Among the benefits of mediation is that it may save you time, aggravation, and money. Mediation programs promote positive dispute resolution rather than adversarial procedures, which is better for all involved.

Child Custody

A significant area of contention in divorce may be child custody.  Our attorneys work with parents to create parenting plans that work for their situation. The parenting plan addresses physical custody (defined as where the child will live) and legal custody (who will make decisions about the child's life). The plan also addresses issues regarding parenting time of the non-custodial parent.

Child Support / Alimony

Issues with respect to the financial obligations of parents and spouses, one to the other, are addressed in the divorce decree. Changes to the decree require an application to the court.  Child support is usually granted to the parent who has physical custody of the child, and is paid by the non-custodial parent. Issues regarding requests to increase or decrease payments, or otherwise modify the original terms, may arise at any time.

Parent and Child Relocation

New Jersey laws require both parents to consent to a move by the custodial parent when the relocation involves a move out of state or out of the country. When parents cannot agree, the family court will review many factors to determine if the move is necessary and in the best interests of the child.

New Jersey Property Division

Division of marital property includes settlement of all assets and debts acquired throughout the marriage, including stocks, 401K plans, pensions, real estate and other property.

In New Jersey, if you are going through a divorce, you need experienced, qualified legal counsel to get you through it.  Our attorneys will work with you to craft a settlement which satisfies your expectations and, if needed, they will help construct a parenting plan that works for you and your family.
