FIRM OF EINHORN HARRIS ARGUES AGAINST FIREMAN'S RULE
IN THE NEW JERSEY SUPREME COURT
On January 29, 2007, attorneys of our office appeared in the New Jersey Supreme Court in the matter of Ruiz vs. Mero to argue that the Fireman's Rule has been abolished in New Jersey by statute. The Fireman's Rule bars police officers and firefighters from recovering damages against a property owner for injuries received while responding to the emergency. Attorneys for the firm argued that the clear, plain and unambiguous language of a statute passed by the New Jersey Legislature permits police officers, firefighters and other first responders to seek recovery for injuries sustained on the job as a result of "direct or indirect" neglect of a person or entity. A decision by the Supreme Court is anticipated by the Spring.
